Purchase regulations

These Regulations define the rules for using the Online Store, in particular the rules for concluding contracts for the sale of goods in the online store’s assortment through the online store, the rules for the performance of these contracts and the rules for complaint proceedings. All goods in the assortment of the Online Store are brand new. The provisions of these Regulations are not intended to exclude or limit any rights of the Customer under the mandatory provisions of law. In the event of non-compliance of the provisions of these Regulations with the above provisions, these provisions shall prevail, and the remaining provisions shall remain in force to the fullest extent permitted by law.

§ 1 Definitions

The terms used in the Regulations mean:

  1. Online Store – an online store available at www.atbmeble.pl, run by the Seller, through which the Customer can purchase Goods from the Seller.
  2. Customer – a natural person, legal person or organizational unit that is not a legal person, the specific provisions of which grant legal capacity, which places an Order within the Store;
  3. Consumer – a customer who is an adult natural person who performs a legal act not directly related to his business or professional activity.
  4. Regulations – these Regulations for the provision of electronic services as part of the atbmeble.pl online store;
  5. Party – Seller and Customer.
  6. Goods – furniture and other accessories that are movable items, produced or delivered by the Seller, presented in the Online Store, that may be the subject of a sales contract.
  7. Sales contract – a contract for the sale of the Goods within the meaning of the Civil Code, concluded between the Seller and the Customer as a result of placing an Order and its confirmation by the Seller using electronic means of communication.
  8. Seller – company ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak, based in Wola Wiązowa 67, 97-438 Rusiec, NIP: 832-000-74-27, REGON: 730008717, entered into the Central Register and Information on Economic Activity conducted by the Minister Economy.
  9. Order – Customer’s declaration of will, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Goods.
  10. Price – the value of the Goods indicated on the website of the Online Store in Polish zlotys together with the applicable tax on goods and services (VAT).
  11. Civil Code (Kodeks Cywilny) – the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended / Dz. U. Nr 16, poz. 93 ze zm.)
  12. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on the protection of data);
  13. Consumer Rights Act (Ustawa o prawach konsumenta) – the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827 / Dz.U. z 2014 r. poz. 827);
  14. Act on the provision of electronic services (Ustawa o świadczeniu usług drogą elektroniczną) – the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204 as amended / Dz. U. Nr 144, poz. 1204 ze zm.);

§ 2 General provisions

  1. These Regulations define the rules for using the online store available at atbmeble.pl .
  2. These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services.
  3. The online store operating at www.atbmeble.pl, is run by ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak, based in Wola Wiązowa 67, 97-438 Rusiec, NIP: 832-000-74-27, REGON: 730008717, entered to the Central Register and Information on Economic Activity kept by the Minister of Economy (Centralna Ewidencja i Informacja o Działalności Gospodarczej), e-mail: atbsklep@banasiak.pl .
  4. These Regulations define, in particular:
    • rules for using the Online Store available at the internet address atbmeble.pl ,
    • concluding contracts for the sale of goods via the Online Store,
    • placing orders for products available in the Online Store,
    • delivery of ordered products and shipping costs,
    • the right to withdraw from the contract, submit and consider complaints.
  5. The Regulations are addressed to all customers of the Online Store. The customer is obliged to comply with all the provisions of the Regulations. The sale takes place on the basis of the version of these Regulations in force at the time of placing the order. The customer is entitled to use the Online Store in accordance with its intended purpose.
  6. Customers can access these regulations at any time and free of charge via the link on the website of the Online Store.
  7. In accordance with applicable law, the company ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak reserves the right to limit the provision of services via the online store to persons over 18 years of age. In this case, potential customers will be immediately notified of the above.
  8. Information about the goods provided on the website of the store, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.

§ 3 Orders

  1. The Customer may place an Order via:
    • the website of the Online Store,
    • contact form Write to us,

    • by e-mail, by sending the order to the e-mail address: atbsklep@banasiak.pl , specifying the quantity and possible variants of the ordered products, payer data, recipient data (if different from the payer’s data), payment method, delivery address, telephone number and address e-mail.
  2. In the event of errors on the Online Store website, in particular with regard to the Price or the availability of the Goods, the Seller will inform the Customer about this fact, enabling him to change the placed Order.
  3. The condition to start using the Online Store is registration and setting up a Customer account.
  4. Registration takes place by filling in and accepting the form available on one of the store’s pages.
  5. The condition for registration is confirmation of reading the provisions of these Regulations, the Privacy Policy and consent to the processing of personal data.
  6. ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak may deprive the Customer of the right to use the Online Store, and may limit his access to some or all of the Online Store’s resources, with immediate effect, in the event of a breach by the Customer of the provisions of these Regulations, in particular when the Customer :
    • provided, during registration in the online store, data that is false, inaccurate or out of date, misleading or violating the rights of third parties,
    • violated the personal rights of third parties via the online store, in particular the personal rights of other customers of the online store,
    • will commit other behaviors that will be recognized by ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak as inconsistent with applicable law or general principles of using the Internet or harming the good name of ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak.
  7. In order to ensure the security of the transmission of messages and data in connection with the services provided on the website, the online store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.
  8. The customer is obliged in particular to:
    • not to provide or transmit content prohibited by law, e.g. content that promotes violence, is defamatory or violates personal rights and other rights of third parties,
    • use the Online Store in a way that does not interfere with its functioning, in particular through the use of specific software or devices,
    • not to take actions such as: sending or posting unsolicited commercial information (spam) as part of the Online Store,
    • use the Online Store in a way that is not inconvenient for other customers and for ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak,
    • use of any content contained in the Online Store only for personal use,
    • use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.

§ 4 Procedure for concluding the contract

  1. In order to conclude a sales contract via the online store, go to the website www.atbmeble.pl, select the goods and their colors from the Store’s offer, taking further technical steps based on the messages displayed to the Customer and information available on the website.
  2. The choice of ordered goods by the customer is made by adding them to the basket.
  3. When placing an order, the Customer has the option to modify the entered data and the selection of the Goods. To do this, follow the messages displayed to the Customer and the information available on the website.
  4. After the Customer using the online store has provided all the necessary data, a summary of the order will be displayed. The summary of the order placed will contain information on:
    • the subject of the contract,
    • the unit price and the total price of the ordered products or services, including delivery costs and additional costs (if any),
    • selected payment method,
    • selected delivery method,
    • estimated delivery time.
  5. In order to send an order, it is necessary to confirm that you have read the Regulations, the Privacy Policy and consent to the processing of personal data provided in the registration form marked as mandatory and pressing the “order and pay” button.
  6. Sending the order by the Customer is a declaration of will to conclude a sales contract with ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak, in accordance with the Regulations.
  7. After placing the order, the Customer receives an e-mail containing the final confirmation of all essential elements of the Order.
  8. The contract is considered concluded at the moment the Customer receives the e-mail referred to above.
  9. The sales contract is concluded in Polish, with the content in accordance with the Regulations.
  10. Personal data is used only for the implementation of orders and – subject to separate consent by the customer – for the processing of his personal data for marketing purposes in order to inform about new products, services and promotions offered by the store www.atbmeble.pl and will not be shared with other entities except for authorized entities. The customer has the right to request the administrator to access personal data, the right to rectify, delete or limit processing, the right to object to the processing, as well as the right to transfer data; I have the right to lodge a complaint with the Personal Data Protection Office when it is justified that my personal data is processed by the administrator contrary to the general regulation on the protection of personal data of April 27, 2016.
  11. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on data protection) ;

§ 5 Delivery and payment

  1. The delivery of the Goods takes place to the address indicated by the Customer when placing the order.
  2. For each product, the Seller provides the order fulfillment time specified in working days. This is the time from placing an order until it is shipped or prepared for personal collection. The order fulfillment time for more than 1 product is provided by the Seller in the information about the acceptance of the order for execution sent to the Customer’s e-mail address, including the date of completion of all ordered products.
  3. The Seller is obliged to immediately inform the Buyer about:
    • shipment or readiness to pick up the order
    • actual and anticipated delays in order fulfillment.
  4. The buyer is obliged to collect the order and settle the amount due in accordance with the selected form of payment and delivery method. In the event of refusal to accept the order, the Buyer is obliged to pay the costs of its delivery and return to the Seller.
  5. A VAT invoice is issued for each order. The VAT invoice is issued when all the Goods ordered by the Customer are completed and ready for shipment.
  6. Orders in the Online Store are carried out by the Seller in the order in which they are received.
  7. Consolidation, security, disclosure and confirmation to the Customer of the essential provisions of the contract for the sale of goods takes place by sending the Customer a confirmation to the e-mail address provided and by attaching a printout of the sales confirmation, receipt or VAT invoice to the shipment containing the goods.
  8. Goods ordered in the Online Store may be delivered to the address indicated by the Customer within the territory of the Republic of Poland or outside the territory of the Republic of Poland.
  9. The Seller is obliged to deliver the Goods which are the subject of the contract without defects.
  10. Orders with delivery to the address indicated are delivered by courier, mail or the Seller’s own transport.
  11. The costs of delivery in the territory of the Republic of Poland are borne by the Buyer. In the case of orders carried out outside the Republic of Poland, the cost of delivery of the goods, regardless of the value of the order, is borne by the Buyer. The cost is determined individually for each order and presented to the customer before confirming the order to the e-mail address provided in the customer’s address data.
  12. On the day of sending the goods to the Customer, the information confirming the shipment by the Seller is sent to the Customer’s e-mail address.
  13. The customer should check the delivered parcel in the presence of an employee of the courier company. In the event of a loss or damage to the parcel, the Customer has the right to demand that the employee of the courier company draw up the appropriate protocol.

§ 6 Prices and payment methods

  1. The prices on the website of the Online Store placed next to the given Product are gross prices and do not include information on delivery costs and any other costs that the customer will be required to incur in connection with the Sales Agreement, about which the customer will be informed in the information confirming the acceptance of the order.
  2. The customer has the option to pay the price

    • in person in cash at the company’s headquarters.

§ 7 Withdrawal from the contract

  1. The customer who is a consumer within the meaning of art. 221 of the Civil Code, you have the right to withdraw from a distance contract without giving a reason.
  2. The withdrawal period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
  3.   4. The store provides a withdrawal form, but using it is not obligatory.
  5. In the event of withdrawal from this contract, we will refund all payments received from you, including the cost of delivering the item (except for additional costs resulting from the method of delivery chosen by you other than the cheapest standard delivery method offered by the Store). We refund payments immediately, and in any case not later than 30 days from the day on which we were informed about your decision to withdraw from the contract. We will refund the payment using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees related to this return.
  6. § 8 Complaints

  1. ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak, as the seller, is liable to the Customer who is a consumer within the meaning of art. 221 of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular in art. 556 and art. 556 [1] – 556 [3] of the Civil Code.
  2. Complaints arising from the violation of the Customer’s rights guaranteed by law or under these Regulations should be directed to the store’s address or the e-mail address: atbsklep@banasiak.pl
  3. ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak undertakes to consider each complaint within 14 days, and if it was not possible, to inform the customer during this period when the complaint will be considered. Complaints may also be submitted electronically on our website www.atbmeble.pl. If you use this option, we will immediately send you a confirmation of receipt of the complaint by e-mail.
  4. If the buyer is not a consumer within the meaning of Art. 221 of the Civil Code, the shop provides a 30-day pre-sale guarantee. It does not provide after-sales warranty.

§ 9 Newsletter

§ 10 Personal data and privacy policy. Information obligations

  1. Personal data provided by the Customer in the registration or ordering process are processed by ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak, based in Wola Wiązowa 67, 97-438 Rusiec, which is the administrator of personal data.
  2. An indispensable element of the account creation and ordering procedure is the Customer’s provision of his personal data, marked as obligatory, and his consent to the processing of his personal data provided during registration. Providing personal data marked as obligatory is voluntary, however, it is necessary for registration and placing an order, their implementation and service. Providing personal data not marked as obligatory is voluntary.
  3. If the Customer has expressed separate consent to the service provided by electronic means, the subject of which is the free delivery of newsletters, the obtained e-mail address (e-mail address) is added to the mailing list and is used for marketing purposes to send the Customer commercial information by electronic means in the form of the Newsletter (E-mail Newsletter), in accordance with point IX of these Regulations.
  4. The consent to the processing of personal data takes place by checking the appropriate box on the form by the Customer.

§ 11 Postanowienia końcowe

  1. Settlement of any disputes arising between ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak and the Customer who is a consumer within the meaning of Art. 221 of the Civil Code, is subject to the competent courts in accordance with the relevant provisions of the Code of Civil Procedure.
  2. The consumer also has the option of using extrajudicial means of dealing with complaints and redress.
  3. Settlement of any disputes arising between ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak and the Customer who is not a consumer within the meaning of Art. 221 of the Civil Code, is subject to the court having jurisdiction over the seat of ATB Meble sc Agnieszka Banasiak, Tomasz Banasiak.
  4. In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
